- Every project has its own written proposal, and that proposal wins over these general terms.
- Fixed scope and price; extra work is quoted and approved before we do it.
- Once you’ve paid in full, you own the custom code and designs we create for you.
- Indian law applies, with the courts of Bengaluru for disputes.
1. About these terms
These terms apply to your use of alphawavehq.com, run by Alpha Wave Technologies (“Alphawave”, “we”, “us”), Bangalore, Karnataka, India. By using the website you agree to them. If you don’t agree, please don’t use the site.
These terms also set out the general basis on which we take on work. Every project is governed by its own written proposal or agreement. If anything in that document differs from these terms, the proposal or agreement wins.
2. Using the website
You may use this website to learn about our services, contact us, book demos and apply for jobs. You agree not to:
- use the site for anything unlawful, or send us false, misleading or someone else’s information;
- try to break, overload or get unauthorised access to the site, our servers or our CRM;
- send spam, malware or automated submissions through our forms or chat assistant;
- copy, scrape or republish the site’s content in bulk without our written permission.
We may block access or remove submissions that break these rules.
3. Information on this website
The content on this website is general information about what we do. It isn’t an offer or a binding quote. Services, features, timelines and prices can change, and what applies to you is what we agree in writing in your proposal.
Client names, logos and project screenshots in our portfolio are the property of their owners and are shown only to describe work we’ve done. Mentioning them doesn’t mean those businesses endorse these terms or have any arrangement with you.
Replies from our chat assistant are generated automatically to help you quickly. They may be incomplete, and they aren’t a commitment: confirm anything important with our team by email.
4. Proposals and projects
When you ask for a proposal we’ll send you a written document setting out the scope, deliverables, timeline, price and payment schedule. A project starts when you accept the proposal in writing (email is fine) and, where the proposal says so, pay the first instalment.
- Fixed scope and price. The price covers the scope in the proposal. Work outside that scope is quoted separately and only done once you approve it.
- Your part. Timelines depend on you providing content, access, feedback and approvals when needed. Delays on either side move the timeline accordingly.
- Third-party costs. Domains, hosting, app-store accounts, paid APIs, software licences and ad spend are paid by you unless the proposal says otherwise, and remain subject to those providers’ own terms.
- Support. Post-launch support and maintenance are as described in your proposal or a separate maintenance plan.
5. Payments
Invoices are payable within the time shown on them. Prices are in Indian rupees (INR) unless your proposal states another currency, and applicable taxes (such as GST for clients in India) are added where required. For international clients, bank and transfer charges are paid by the sender.
If an invoice is overdue, we may pause work until it’s paid. Refunds, if any, are as set out in your proposal or agreement.
6. Who owns the work
Unless your agreement says otherwise:
- You own what we build for you. Once you’ve paid in full, ownership of the custom code, designs and content we create specifically for your project passes to you, and we hand over the source code and the accounts set up for you.
- Our tools stay ours. Our pre-existing code, libraries, templates and know-how remain ours; you get a permanent licence to use any of them included in your deliverables.
- Third-party components (open-source libraries, fonts, stock images, plugins, platforms) stay under their own licences.
- Portfolio. We may mention your company and show the finished work in our portfolio, unless you ask us not to or confidentiality has been agreed.
The content of this website — text, design, graphics and our logos — belongs to Alpha Wave Technologies and may not be reused without our permission.
7. Confidentiality and data
We keep the business information you share with us confidential and use it only to work on your project. We’re happy to sign a non-disclosure agreement before you share sensitive details.
How we handle personal data is explained in our Privacy Policy. Where we process personal data on your behalf as part of a project, we do so only on your instructions and can sign a data processing agreement on request.
8. Third-party links and services
Our website links to other services, such as WhatsApp, Instagram, Facebook and our product websites. We aren’t responsible for their content or how they handle your data; their own terms and privacy policies apply.
9. Disclaimers and liability
We work hard to keep this website accurate and available, but it is provided “as is”. We don’t guarantee it will always be uninterrupted or error-free.
To the extent the law allows, we aren’t liable for indirect or consequential losses (such as lost profits, revenue or data) arising from your use of this website. For projects, our total liability is limited as set out in your proposal or agreement and, if it says nothing, to the fees you paid us for the work concerned.
Nothing in these terms limits liability that can’t be limited by law, such as liability for fraud.
10. Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, we’ll first try to resolve it in good faith by talking with you. If we can’t, the courts of Bengaluru, Karnataka, India have exclusive jurisdiction, unless your agreement sets out a different process.
11. Changes to these terms
We may update these terms from time to time. The “last updated” date at the top shows when they last changed. Changes don’t affect projects already agreed in writing.
